READ CAREFULLY. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

I, a member or guest of Heiliger Huegel Ski Club, Inc. and Heiliger Huegel Foundation for Outdoor Education, Inc. (“Ticket Holder” or “Releasor”) understand that Alpine Sports in their various forms, including but not limited to alpine or nordic skiing, sledding, tubing, ski jumping, mountain biking, snow shoeing, snowboarding, and spectating or facilitating those endeavors  involves risks, dangers and hazards that may cause serious personal injury or death and that injuries are a common and ordinary occurrence. Risks include, but are not limited to, changes in terrain, weather and snow surfaces, ice, moguls, bare spots, rocks, stumps, debris, fences, posts, trees, chairlift and surface lift equipment and towers, light poles, signs, buildings, roads and walkways, rails, boxes. jumps and other terrain features (including their approaches and the angle of their take-off ramps and landing areas) both in and out of any terrain park, padded and non-padded barriers and obstacles, snowmaking, snow grooming, snowmobile operations, and collisions with other persons and other natural and man-made hazards. I acknowledge that the risks in the sport can be greatly reduced by taking lessons, abiding by the Skier Responsibility Code (known as Your Responsibility Code), and using common sense. If I am a member of Heiliger Huegel Ski Club, Inc., I confirm that I executed the Club’s standard release if and when I joined the Club and that this Release supplements that earlier release and that both remain in full force and effect.

In consideration of the purchase of a lift ticket or membership in Heiliger Huegel Ski Club, Inc. and use of its facilities, I RELEASE AND FULLY DISCHARGE Heiliger Huegel Ski Club, Inc. and Heiliger Huegel Foundation for Outdoor Education, Inc., and their members, officers, directors, and employees (collectively “RELEASEES”) from any liability resulting from any personal injury to myself, including death, or damage to my property with respect to:

•      the design, location, construction, inspection, maintenance and repair of trails, ski runs and slopes;

•      the design, location, construction, inspection, maintenance and repair of terrain features, including rails, boxes, table top and other forms of jumps, including their height, the location of start position, the angle and length of approaches and decks, and the angle and length of takeoff ramps and landing areas;

•      grooming, snowmaking, and snowmobile equipment and operations;

•      the operation of chairlifts and surface lifts and chairlift and surface lift loading, riding, and unloading including the absence of restraint bars on chairs;

•      the training and equipment necessary to safely unload the skier in the event the skier is slipping out of or hanging from a chairlift;

•      padding or non-padding of natural and manmade obstacles and hazards;

•      posting or failure to post warnings and signs, and the construction or failure to construct fences or other barriers, including the selection of the construction materials; and

•      classification and labeling of trails and ski runs.

Nothing in this Release should be considered as releasing, discharging or waiving any claims I may have for reckless or intentional acts on the part of any RELEASEE.  

I HAVE READ THIS RELEASE AND UNDERSTAND ITS CONTENTS.  I AM AWARE THAT BY SIGNING THIS RELEASE, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE HEILIGER HUEGEL SKI CLUB, INC. AND HEILIGER HUEGEL FOUNDATION FOR OUTDOOR EDUCATION, INC., AND THEIR MEMBERS, OFFICERS, DIRECTORS, AND EMPLOYEES FOR CERTAIN CLAIMS. 

OPTION TO DECLINE TO BE SUBJECT TO RELEASE ON PAYMENT OF OPT-OUT FEE

I UNDERSTAND I MAY EXERCISE THE OPTION TO DECLINE TO BE SUBJECT TO THIS RELEASE UPON WRITTEN NOTICE AND PAYMENT  OF AN OPT-OUT FEE OF FIFTEEN DOLLARS ($15.00) EACH TO HEILIGER HUEGEL SKI CLUB, INC. AND THE HEILIGER HUEGEL FOUNDATION FOR OUTDOOR EDUCATION, INC. ON EACH ALPINE SPORTS VISIT BY RELEASEE TO RELEASOR’S PROPERTY OR FACILITIES.

THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS AND WILL BAR YOUR RIGHT TO SUE!

As parent or guardian (“Releasor”) of the above-named minor(s), I have read and understand the foregoing Release of Liability and, on my behalf and on behalf of my child(ren) or ward(s) named above, I agree to all terms contained therein.  In doing so, I agree to RELEASE AND FULLY DISCHARGE Heiliger Huegel Ski Club, Inc. and Heiliger Huegel Foundation for Outdoor Education, Inc., and their members, officers, directors, and employees (collectively “RELEASEES”) under the terms described in the foregoing Release of Liability.  I accept full responsibility for any injury or damage to my child(ren) or ward(s) including death, which may result from Alpine Sports at Heiliger Huegel, and I agree to HOLD HARMLESS the RELEASEES for any injury or damage sustained by my child(ren) or ward(s), including death, while participating in Alpine Sports at Heiliger Huegel.  I agree not to bring any action or suit against the RELEASEES for any injury or damage for any of the above negligent acts or omissions of any release.  I represent I have full authority to sign on behalf of my child(ren) or ward(s) named as Ticket Holder above, realizing that my agreement to the above Release of Liability is binding upon my child(ren)/ward(s) as well as myself,
